1. Agreeing to these terms
These terms are between you and the person who makes Koh ("we"). By using the Koh app or Koh's server, you agree to them and to the privacy policy. The app itself is licensed to you under Apple's standard license agreement; these terms add the rules for circles and for Koh's server.
You need to be at least 13, and old enough where you live to agree to terms like these.
2. Your posts
Everything you post, including photos, videos, captions, and comments, stays yours. You let us store and pass on the encrypted copies only so your circle can see them. We can't read them, and we don't use them for anything else.
You're responsible for what you post. Only post things you have the right to share, and ask before posting photos of people who'd mind.
3. What's not allowed
There's no tolerance for objectionable content or abusive people in Koh. Don't use it to:
- share sexual content involving minors, or anything that exploits or endangers a child;
- share intimate images of someone without their consent;
- harass, threaten, bully, or stalk anyone, or encourage violence or self-harm;
- post hateful content that attacks people for who they are;
- break the law, or share things you don't have the rights to;
- send spam, or invite people who didn't want to be invited;
- attack, overload, or try to break into Koh's server, the relay, or other people's phones.
4. Reports and removal
Because circles are end-to-end encrypted, we can't see or scan what's in them. Instead, anyone can press and hold a post, comment, or message in the app and report it:
- Something rude, or that doesn't belong, goes to the circle's host, who can delete it or remove the person who posted it.
- Hate, bullying, threats, a private photo shared without consent, or anything else illegal goes to the host and to us. Your phone shows us that one post or message, so we can check it.
- Sexual content involving a child comes only to us, never to the host.
- A host's own posts are reported to us, since nobody in the circle is above the host.
- You can also write to us at hello@joinkoh.com.
On Koh's server we act on reports within 24 hours. If something breaks these rules, we can delete it, remove the person who posted it, or close the circle so nothing new can be posted, without a refund. We act on the person who posted it, and close a circle only when its host is part of the problem. We report child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC), as the law requires.
If you can't be in a circle with someone, leave it, or ask the host to remove them. There's no blocking inside a circle.
5. Hosting a circle
If you start a circle, you choose who's in it and you look after it: you can remove people, delete posts and comments, and delete the whole circle, which freezes it at once and deletes it after 3 days unless you cancel. Invite only people who want to be there, and act on reports from your circle.
6. Koh's server
Hosting circles on Koh's server is a subscription bought in the app. People who join a circle don't pay.
- Apple bills you and the subscription renews automatically until you cancel it in your Apple Account settings, at least 24 hours before the period ends.
- A free trial, when offered, is once per Apple Account, and the subscription starts charging when it ends unless you cancel.
- Refunds go through Apple, under Apple's rules.
- Each plan includes a set amount of storage, shared across your circles. A full circle can't take new posts until space is freed or the plan changes.
- If the subscription ends, your circles become read-only: everyone can still see them, but nobody can post.
- If prices change, Apple will tell you before you're charged the new price.
7. Your own server
The Koh server is open source, and anyone can run one. If a circle is on someone's own server, we don't run, see, or control it, and we can't remove anything from it. Whoever runs that server is responsible for it and for the circles on it, and serious reports from those circles go to them. If nobody takes reports on that server, the app lists where to get help instead.
8. Keys and backups
Your keys live on your phones, and in iCloud Keychain if you use it. A host's recovery code also opens a sealed backup of their keys on the server, which we can't open without the code. If a host loses every phone, their iCloud Keychain, and the recovery code, nobody, including us, can take the host's place, though people still in the circle can still open it.
Koh isn't a backup of your photos. The circle stores smaller copies, and your originals stay on your phone. Keep them.
9. No guarantees
Koh is made by one person and offered as is. We work to keep it running and safe, but we can't promise it will always be available, free of bugs, or never lose anything. To the extent the law allows, we disclaim all warranties, express or implied.
To the extent the law allows, we aren't liable for indirect or consequential losses, or for lost data, and our total liability to you is limited to what you paid us for Koh's server in the 12 months before the claim, or $50 if that's more.
We may change or stop parts of Koh. If Koh's server is going to shut down, we'll tell you in the app with as much notice as we can.
10. Ending
You can stop anytime: leave a circle, or delete the circles you host (which are deleted after 3 days unless you cancel), from People in the app, and cancel any subscription in your Apple Account settings. We can end your use of Koh's server if you break these terms.
11. The legal part
These terms are governed by the laws of Texas, USA. If these terms change, the date at the top changes too, and for important changes we'll tell you in the app. Using Koh after a change means you accept it.
